# ENDORSEMENT NUMBER: FIVE

## U.S. TERRORISM RISK INSURANCE PROGRAM REAUTHORIZATION ACT AND NON-CERTIFIED ACTS OF TERRORISM COVERAGE ENDORSEMENT - II

It is hereby noted and agreed that the Terrorism Exclusion, if any, to which this Policy is subject, shall not apply to any covered loss directly resulting from a "certified act of terrorism" as defined in the "Terrorism Insurance Program" established by the United States "Terrorism Risk Insurance Program Reauthorization Act" or a "non-certified act of terrorism".

The coverage afforded by this Endorsement is only in respect of any insured loss of the type insured by this Policy directly resulting from an "act of terrorism" as defined in the "Terrorism Insurance Program" or a "non-certified act of terrorism".

Furthermore, the Insurer will not be liable for any amounts for which it is not responsible under the terms of the "Terrorism Insurance Program" established by the United States "Terrorism Risk Insurance Program Reauthorization Act" (including any subsequent action of Congress pursuant to the Act) due to the application of any clause which results in a cap on the Insurer's liability for payment for any covered losses directly resulting from a "certified act of terrorism".

For purposes of this Endorsement, "non-certified acts of terrorism" means any act, or preparation in respect of action or threat of action designed to influence the government de jure or de facto of any nation or any political division thereof, or in pursuit of political, religious, ideological or similar purposes to intimidate the public or a section of the public of any nation by any person or group(s) of persons whether acting alone or on behalf of or in connection with any organization(s) or government(s) de jure or de facto, and which:

1. involves violence against one or more persons;
2. involves damage to property;
3. endangers life other than the person committing the action;
4. creates a risk to health or safety of the public or a section of the public; or
5. is designed to interfere with or disrupt an electronic system.

All other terms, conditions, limitations and exclusions of this Policy remain unchanged.
