# EXCESS OVERLAYER INDEMNITY
(POLLUTION LIABILITY EXCLUSION)

It is agreed that:

I. This policy does not apply:
A. to excess net loss arising out of the actual, alleged or threatened discharge, dispersal, release or escape of pollutants; or
B. to any loss, cost or expense arising out of any:
1. Request, demand or order that any insured or others test for, monitor, clean up, remove, contain, treat, detoxify or neutralize, or in any way respond to, or assess the effects of pollutants; or
2. Claim or suit by or on behalf of a governmental authority for damages because of testing for, monitoring, cleaning up, removing, containing, treating, detoxifying or neutralizing, or in any way responding to, or assessing the effects of pollutants.

Subparagraph I. A. does not apply to excess net loss arising out of heat, smoke or fumes from a hostile fire.

II. As used in this endorsement:
"Excess Net Loss" is as defined in Section 2 of this policy.
"Hostile Fire" means one which becomes uncontrollable or breaks out from where it was intended to be.
"Insured" is as defined in Section 2 of this policy.
"Pollutants" means any solid, liquid, gaseous, or thermal irritant or contaminant, including smoke, vapor, soot, fumes, acids, alkalis, chemicals and waste. Waste includes materials to be recycled, reconditioned or reclaimed.

This endorsement forms a part of the policy to which attached, effective from its date of issue unless otherwise stated herein.
