**Dear Chris:**

Sometime ago, the definition of bodily injury under the captioned policy was amended to include shock, mental injury and mental anguish. Although not intended this wording may inadvertently have reduced coverage provided under the personal injury section. A review of the current definition states that personal injury means "injury other than bodily injury, arising out of one or more of the following offenses ...."

To correct the above and provide IBM with the broadest coverage possible, we are attaching Endorsement #40 effective May 21, 1991 to be added to your Commercial General Liability policy. Note that the definition of personal injury now means "injury other than bodily injury (except as respects shock, mental injury, mental anguish) arising out of one or more of the following offenses ...." With the addition of Endorsement #40, IBM is now protected from mental injury, mental anguish or shock claims arising out of occurrences resulting in bodily injury or from offenses resulting in personal injury.
