**(h) A determination by the Superintendent that the continuation of the policy would violate, or place the company in violation of, any of the New York Insurance Laws;**

**(i) Where the company has reason to believe, in good faith and with sufficient cause, that there is a probable risk or danger that the Insured will destroy, or permit to be destroyed, the Insured property for the purpose of collecting the insurance proceeds, provided that any cancellation notice based on this reason:**

**(i) Is provided simultaneously to the Insurance Department; and**

**(ii) Informs the insured in plain language that the insured may request a review of the cancellation by the Department within (10) ten days of receipt of notice; or**

**(j) Cancellation of one or more of the underlying insurance policies which provide primary or intermediate coverage if:**

**(i) The cancellation of the underlying insurance policy(ies) is based on the reasons outlined in (a), (b) or (c) above; and**

**(ii) The insured fails to replace the underlying insurance policy(ies).**

**C. If notice is mailed, the company will mail it to the first named Insured's last mailing address known to the company.**

**Proof of mailing will be sufficient proof of notice.**

**D. Notice of cancellation will state the effective date of cancellation and the specific reason(s) for cancellation. The policy period will end on that date.**

**E. If this policy is cancelled, the company will send the first named insured any premium refund due. If the company cancels, the refund will be pro-rata.**

**F. If the first named insured cancels, the company shall compute the return premium at 90% of the pro-rata unearned premium, but the company shall in any event be entitled to retain any minimum retained premium stated in the Declarations.**

**3. The following Conditions are added to the policy:**

**Non-Renewal**

**If the company decides not to renew this policy, it will mail or deliver written notice of non-renewal to the first named insured and his or her agent or broker at least thirty (30) days but not more than one hundred twenty (120) days before the end of the policy period. The notice will state the reason or reasons for non-renewal.**

**If notice is mailed, the company will mail it to the first named insured's last mailing address known to the company.**

**Proof of mailing will be sufficient proof of notice.**

**Notice of Premium or Coverage Changes**

**If the company elects to increase the policy premium by more than 10% (not applicable to experience rating, retrospective rating, policies subject to audit or insured value added), change a deductible, reduce limits or make a substantial change in coverage, it will mail or deliver to the first named Insured written notice of such change at least thirty (30) days but not more than one hundred twenty (120) days before the end of the policy period.**

**If notice is mailed, the company will mail it to the first named insured's last mailing address known to the company.**

**Proof of mailing will be sufficient proof of notice.**
