## A. Statement Under Oath

After a statement under oath that the insured or his legal representative has been involved in an accident resulting in damage against a person or persons whose identity is unknown, and forthwith forth the facts in support thereof, and at the company's request, the insured or his legal representative may arrange for the return of the vehicle which the insured was occupying at the time of the accident.

## B. Insured and Coverage of the Insured

The term "insured highway vehicle" means a highway vehicle as described in the schedule as an insured highway vehicle to which the bodily injury liability coverage of the policy applies.

## C. Notice of Legal Action

If notice of any legal action is made by the company, the company may require the insured to provide information and any legal action for specific injury against its person or organization legally responsible for the accident. The company shall be notified of the legal action within 10 days after the occurrence of the accident, and such person or organization shall be notified as a party throughout.

## D. Other Insurance

With respect to bodily injury to an insured while occupying a highway vehicle as described in the schedule, this insurance shall apply only as excess insurance over any other insurance covering such person or organization legally responsible for the accident. The company shall not be liable to pay any amount in connection with such legal action that is reimbursed immediately by the company by the insured or his legal representative.

## E. Arbitration

If any person making claim hereunder and the company do not agree that such person is legally entitled to recover damages from the owner or operator of an uninsured or underinsured motor vehicle, bodily injury to the insured, or do not agree as to the amount of payment which such person is legally entitled to receive, they may submit their dispute to arbitration which shall be conducted in accordance with the rules of the American Arbitration Association unless other means of conducting the arbitration are agreed to between the parties. The award rendered by the arbitrators may be entered in any court having jurisdiction thereof. Such person and the company each agree to contribute toward said cost to be borne by any award made by the arbitrators pursuant to this insurance.

## F. Trust Agreement

In the event of payment to any person under this insurance, the company shall be entitled to the extent of such payment in the proceeds of any settlement or judgment that may result from the exercise of any rights of recovery by such person against any person or organization legally responsible for the bodily injury because of which such payment is made.

Such person shall hold in trust for the benefit of the company all rights of recovery which he shall have against any person or organization because of the damages which are the subject of Claim under this insurance.

Such person shall do whatever is proper to secure and must do nothing after loss to prejudice such rights.

If requested in writing by the company, such person shall take through any action or proceeding by the company, such action as may be necessary or appropriate to effect the collection of any such recovery. If such action is taken by such person, the company shall be reimbursed out of such recovery for expenses, costs and attorneys' fees incurred by it in connection therewith.

Such person shall execute and deliver to the company such instruments and papers as may be appropriate to effect the collection of such person and the company established by this provision.

## G. Payment of Loss by the Company

Any amount due hereunder is payable:

- To the insured, or
- To the insured as a minor to his parent or guardian or
- To the insured to be released to his surviving spouse, children, or
- To a person authorized by law to receive such amount if such person is a person legally entitled to recover the damages which the Insured represents, provided the company may at its option pay any amount hereunder in accordance with Section 10 hereof.
