## NEW YORK CHANGES - AMENDATORY ENDORSEMENT

This endorsement modifies insurance provided under the following:

### EXCESS LIABILITY POLICY

The following is amended under the second paragraph of SECTION I - COVERAGES:

We shall be furnished a completed copy of each policy described in Item 5 of the Declarations. You shall notify us of any change in coverage or Limits of Insurance, other than a reduction in any aggregate limits as the result of the payment of a claim. Your failure to do this shall not invalidate this policy but, in the event you do fail to report such change, we shall be liable for loss to the same extent that we would have been had no change been made.

The following is added to or amended under SECTION III - CONDITIONS:

4. **Notice of an Occurrence**
   a. Whenever it appears that an occurrence is likely to involve this policy, written notice shall be given to us. Such notice shall identify you and include any reasonable obtainable information about the occurrence. This information shall be given as soon as reasonably possible.
   b. Notice given by or on behalf of the Insured, or written notice by or on behalf of the injured person or any other claimant, to any licensed agent of the insurer in this state, with particulars sufficient to identify the Insured, shall be deemed notice to the insurer.

6. **Judgments**
   If any judgment against you for damages has not been satisfied at the expiration of thirty (30) days from the serving of notice of entry of judgment upon you or us, then an action may, except during a stay or limited stay of execution against you on such judgment, be maintained against us under the terms of the policy for the judgment amount not exceeding the policy's applicable Limit of Insurance.

7. **Bankruptcy or Insolvency**
   a. Bankruptcy or insolvency of the "Insured" shall not relieve us of any of our obligations under this policy.
   b. In the event of bankruptcy or insolvency of any underlying insurer, the insurance afforded by this policy shall apply as if the "underlying insurance" was valid and collectible.
