# Additional Policy Provisions - 178436 12 91S

Excess Liability Policy

A. The second paragraph at the top of Page 1 of 5 of the policy, which begins with the words "Wherever boldfaced in this policy", is replaced by the following:

(1) Wherever used in this policy:
(a) The words **You**, **Your** and **Insured** refer to any person or organization for which insurance is provided by this policy; and
(b) The words **We**, **Us** and **Our** refer to the Company providing this insurance.
(2) Other words and phrases that are boldfaced in this policy or that are boldfaced and/or underlined in the endorsements attached to this policy have special meaning. Refer to the DEFINITIONS section of this policy.

B. INSURING AGREEMENTS, III. LIMITS OF INSURANCE, section B. is replaced by the following:

B. (1) The Limits of Insurance stated in Item 4 of the Declarations as "aggregate" is the most **We** will pay for all losses covered by this policy and sustained during **Our** policy period. Such "aggregate" limit:
(a) Will not apply to loss when "first Underlying Insurance" does not apply an aggregate limit to loss, provided all other Underlying Insurance also does not apply an aggregate limit to loss; and
(b) Will apply to loss in the same manner as the aggregate limit in "first Underlying Insurance" applies to loss, provided all other Underlying Insurance also applies an aggregate limit to loss in the same manner as "first Underlying Insurance" and
(2) If, after this policy has been issued, We extend Our policy period, We will consider the additional period as part of the original policy period to determine how to apply Our aggregate limit.

C. CONDITION 5. NOTICE OF OCCURRENCE-INSURED'S DUTIES., the first sentence is replaced by the following:
You must see to it that We are notified as soon as practicable, in writing, of any occurrence or offense which may result in a claim under this policy.
All other terms and conditions of the policy remain unchanged.

This Form must be attached to Change Endorsement when issued after the policy is written.
