# Absolute Pollution Exclusion - Amended

This endorsement changes the policy. Please read it carefully.

## Excess Policy

This policy does not apply:
- **a.** To Personal Injury or Property Damage directly or indirectly caused by, resulting from, or arising out of the actual, alleged or threatened discharge, dispersal, release or escape of "pollutants," or
- **b.** To any loss, cost or expense directly or indirectly caused by, resulting from or arising out of any request, direction or order to test for, monitor, clean up, remove, contain, treat, detoxify, or neutralize "pollutants."

The Company shall have no duty or obligation to provide or pay for the investigation or defense of any loss, cost, expense, claim or suit excluded under a. or b. above.

However, paragraph a. of this exclusion does not apply to liability resulting from the collision, upset or overturn of a motor vehicle, or the smoke, heat or fumes of a "hostile fire" which means a fire which becomes uncontrollable or breaks out from where it was intended to be,

if such liability is covered by valid and collectible underlying insurance as listed in Item 5. of the Declarations, for the full limits of liability shown therein, and then only for such hazards for which coverage is afforded under said underlying insurance.

"Pollutants" means any solid, liquid, gaseous or thermal irritant or contaminant, including but not limited to smoke, vapor, soot, fumes, acids, alkalis, chemicals and waste, including materials to be recycled, reconditioned or reclaimed.

All other terms, conditions and warranties remaining unchanged.
